Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.
Many of us could be over-qualified for our current EB3 position (after so many years of wait) and is accepting the current position only to strictly adhere to "same/similar" job classification. In that case employer can file a GC for our real qualification i.e. Eb2.

Mine seems to be few of last applications entered in system during July 07 visa bulletin fiasco(rather fiesta). My Notice date 10/17. I have not seen July filer notice date, later than this...
My notice date is 10/10. It seems cases are approved based on the notice date. My case was transferred from CSC to TSC. You are right that only few cases have Oct notice dates.

Nope, I got only one set. A friend of mine got two set he and his spouse filed each other as dependent.

The Ad says for client IBM Federal. Looks like might be for some federal projects that requries US Citizens. They could have mentioned need US Citizens with clearance, or people elligible to apply for clearance. May be the choice of words wasn't good... Regardless, this could occur more too... if the economy does not improve. Anyway, I think IBM should not have any problem with EAD and they themselves do sponsor GC, etc..
Hmmm - not sure because, if the job requires that someone must have security clearance - the job must clearly mention that someone with security clearance is needed. What is the point in hiring a citizen without security clearance (unless they want you to get clearance aftewr hiring)

The only way out is legislation. Even this eb2 trend of approvals will end come october.
With the earlier method or the current method, EB3-I will always end up last. Vertically EB3-ROW gets the excess visas (old method), horizontally EB2-I gets the excess visas (new method). So, either way EB3-I won't benefit, the only solace being that with the current system atleast our EB2-I friends are getting their freedom faster.

I am really surprised by the meek response...what is wrong with everyone?? We have just abt 54 letters so far and almost 200 members online right now !!!

What is the least effort that you can put towards your immigration?
If you cannot write or type a letter, i'm afraid you don't belong to the "Hard working, highly skilled" immigrants that is being referred to in the letter.

You can dissect it a million ways from here to sunday, the fact of the matter is that EB 3 as a whole and E3 I&C in particular are messed up big time. We cannot sit twiddling our thumbs while we wait, most EB3s have supported most of the action items. What is wrong in exploring different options. we are not obstructing anybodys efforts. Vertical allocation or horizontal allocation doesnt matter, what matters for most is that there should be consistency in actions. They keep changing the rules every couple of months. if we know the number of people stuck in each category per year/per country we can come to our own conclusions and decide if we want to stay or go. There are greener pastures everywhere. Every year our lawyer tells us that its a matter of 12-18 months and you keep waiting...the only reason is that...we have been waiting so long, lets wait a couple more and see. i know some will immediately give comments like, 'leave sooner, one less family in the queue'..or..'port to EB 2 you ##$@'...to them i say i hope you are fortunate enough to avoid getting trapped in a situation like us.

gc26...., It seems that you have missed the point again. Any logical person will have the capability to comprehend that this thread is against visa abuse in L1 category.. If you still didn't get it, objective is to explore the options to report abuse of L1. Benefits are: genuine people still get the opportunity, reduce over supply in market, not bring wages down etc.

So then we all need to agree that the person foreclosing has no right to blame the lender. It is people like you and me whose tax money will be used to bail out banks that have the right to blame them AND the borrower! :)
100% with you. What is so irritating is that these guys (both bank and the individuals) are getting away with 'nobody saw this coming'. I have been begging my friends not to get into this mess for years. If I can see this, I am sure the banking professionals, economist would have seen this too. They just wanted to make money (greedy %&*^%^&*). Probably they thought the government will bail them out since all the banks are doing it anyway. After this mess is cleaned out, no one will again talk about flipping house for a long long time:D

Have a questions for the Gurus...Is Credit Check performed during any of the processes related to FBI (for people who are present in the US with a SSN) ? IF so, will a Foreclosure in the credit check cause any problems or delays in adjudicating the 485 petition ?

LC substitution was wrong because it became a business thing for some unscruplous employers who started to sell LCs and get people to work like slaves. That being said I have no ill feelings towards people who used the opportunity to get their GCs faster, albeit by puttting in more of their money and/or working like slaves for a better life in the future (hopefully). EB3 to EB2 portability is someone trying to better his/her life after suffering in the queue forever and I have no issues with such people.
I, therefore, cannot support this case. BTW, I am an EB2-I with Sep. 2006 PD.

Hi Folks,
In many of the articles and forums I have read that applicants spent a lot of money on medical exams, lawyer fees, and so on towards the Employee based Green Card application.
Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?
From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)
Any comments ?

Point to be noted is that this case was not dismissed on merit, but that plaintiff's have not been able to prove significant damages resulting from the rule. A general 'dissatisfaction' with the rule ( for e.g. my wait times will increase if porting continues) doesnot translate into significant damages ( such as I'm losing the job). The merit of the case was never discussed!.
It would be interesting to see how many of the 'Yes' are going to remain 'Yes' when it comes to having their names on a lawsuit filed against USCIS (the whole list will be going to USCIS). It will be interesting to see how many of you stridently remaining anonymous on a (relatively) harmless public forum such as IV are going to come out in public to fight the USCIS. Good luck guys.
And happy nightmares whenver your cases get (not so) Soft LUDs. Is it because you joined the case? you never know.

It does not matter where you connect the vonage router. Just make sure none of your internet traffic is routed through vonage router. Vonage router should be be handling voice traffic only.

You want to foreclose for a matter of 20K -- I'm really surprised by your thinking process. Based on it, I would assume you had a zero down loan.
In my opinion and this is my opinion only ( and this is only from a financial perspective only ), taking a hit on your credit report for 7 years for a 20k monetary hit doesnt make sense.

Call the place where you've ordered flowers and ask for a refund if flowers are delivered elsewhere. It should be up to USCIS to recieve and then ship those flowers to the hospitals.
