I left the SSN for my wife blank in I-765
My attorney told me to fill in ITIN # if available.
My wife is on H4 and she do have ITIN#.
I am confused.

Restrictions on H1B is definitely not going to help retain jobs in America. More technnical jobs will be outsourced. My friend work for a TARP company and they are directed to move more technical jobs to offshore. The raid and other things what they are doing now will certainly prevent fraud.

It may not have any impact on EB3 this year...but once the EB2 is cleared it will have an impact on EB3; may be in a year or two.

I have seen some of your posts and looks like your the oldest waiting since the dates have been current. Are you considering filing WOM since you will be current for 4 months by Oct. What is lawyer saying? Although I have been just current for 12 days the wait seems forever so I understand how you must be feeling.
What did your senator/congressman say?
Where is your application TSC or NSC? If it is TSC, did you try to send email to streamline email address? I know you must have done everything. Also you can try to goto the local office and have them issue you a FP notice if they have expired. Maybe that will set things in motion since I know some IOs just want to issue another FP and not refresh the old one in their systems.

Once we have recapture we can start pushing USCIS to follow FIFO on PD. but to do that first we need numbers.
Lets forget all thread only for today and make call.

Where is your case at? Is it TSC or NSC? If it's TSC, please send me a private message and I will give you the name of the IO. You really need to talk to this IO, and I think you will get the exact info you need.
As one of the posters mentioned earlier, your case with the IO could mean:
1) It's either in the holding area
2) Or with the officer on their desk
You want to somehow get your case to 2 - on the officers desk. If its sitting in the holding area, you can ask the IO (if they are willing to help) to send a polite reminder to the IO who your file has been assigned to letting them know that your case is current and needs to be looked at.
Another thing the IO mentioed to me was that the case could sit in the holding area for long if the IO that the case has been assigned to is on vacation (or out sick). I'm hoping that's not the case with your application

EB3 will not any visa from recapture bcoz it will go to EB2 first. EB2 line is not going to clear in next 10 years bcoz nowadays everybody applies in EB2 and as they move VB forward for EB2, more and more people apply for AOS and it never ends.
So EB3 won't be benefited by recapture unless there is a clause specifically for EB3 allotment out of that recapture
We need some numbers to back this up. I think you are saying EB2 will not become current even with the recaptured number. There is another thread for requesting numbers from USCIS about pending applications per category, per country. So, participate in that campaign as well.
We need the numbers. I would have guessed roughly 50% of pending 500K applications are from India, 50% of that is EB2, so recapture of 200K visas should help.

It’s more than 90 days but I didn’t even get the Receipt Notice for said application. How I can get the EAD in 90 days per law when i didn't even get the Receipt Number from USCIS?
USCIS website update says NSC are working with August 13th 2007 received AOS applications. USCIS is not following the First in First out (FIFO) process for sure. Why August received application are getting Receipt Notice and subsequent benefits (EAD, AP, etc) at the expense of July 2nd filed application? It’s unfair to applicant like me.
