I have sent the letters today to WH and IV.
I have also sent group emails to my batchmates from my engg college asking them to join IV. I think everyone should do that - this will help IV to Increase its Memberships.
I had one more suggestion too - (this has recd less support in the past).
we need to put in a statement that many legals are not buying a house because of the uncertainity in the GC process. even the congressmen will be more patient with our cause when we mention housing.

furthering the displacement of skilled American workers (programmers, engineers, scientists, etc.)How will I displace an American worker if I get a green card sooner? I am already here and already doing a job that DOL certified no other American is willing qualified or able to do!! :D

Would anyone be able to advise if I can travel out of the country after I've filed the 485 if I have an approved I-797 approval notice (for H-1B) but old H-1B stamp in pp has already expired?
If I travel out and then get the H-1B visa stamp at an outside consulate, I would be able to travel back in, but would I have considered have abandoned the 485 application? (since I travelled out without a valid H-1B stamp in pp)??
Can I travel out even before my AP arrives? Or does having an AP make a difference? I would prefer to stay on H-1B status since you never know what happens to the 140/485 application.

Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.

As a highly skilled H1B worker in the US, let me the set the record straight on a few common misconceptions:
- Many of us come from upper middle class families and didnt come to the US 'seeking quality of life'. We already had it.
- Many of us have graduated with distinction or higher from TOP US universities where we competed with 'local' talent and aced the programs, with NO SPECIAL FAVORS
- All of us are PASSIONATE about the PROMISE of the GREAT AMERICAN DREAM. We work hard because we want to, not because we need to. (Hint: We are ambitious and can hence go to any country in the world!)
- All of us are an INTEGRAL part of this society, paying 28%-33% of our $100K+ jobs as TAXES that go back to the US economy
- All of us continue the great tradition of the US being a melting pot
Go back to the age of the Gold Rush. We are the new Gold Rush. We are the new Lewis and Clarke. We are adventurers, learners, experiments, believers, doers.
We are not lowly paid 'tech slaves'. Get the media misconception out of your heads.
We are PROUD to be part of the Great American Fabric. We strengthen this country with our diversity. We will continue to contribute selflessly to make this a greater, stronger nation.
And while we are it, we wont forget that our own future generations might take it more lightly and risk messing up their careers. Anyone that has 'life handed to them in a platter' ends up messing it.

Seriously I am also sick of these violations and the companies everywhere in the world take law on a ride. No harm had happened to me but still irritates me when they get the GC in 1 year and we waiting for ever.
Call USCIS and they should be able be give you the right direction. Please update us on how it goes.

Hi I called TSC yesterday, when i tried to inquire about is my case is pre approved or not, it seems the representative does not have any idea about it. and he just opened a service request and gave me a number.
Is this the way you guys get to know that your case is pre approved or not, or do i need to do some thing differently.

So basically he is saying that count your blessings and thank god that you are stuck in Backlog centers or in retrogression because in Europe, its even worse. Its a nice way of saying : "It is what it is, take it or go to Europe or go back to India".

Does he know that the USCIS does not even have a clue on how many potential applicants it would expect if it moved PD forward by a certain period? Backlog centers are 20 years behind schedule already? People cant get drivers license in Pennsylvania coz they get only 1 year extensions on H1 due to labor backlog and their wives are driving them to work? Does he know that there is a name-check process that FBI sometimes takes forever which is not only hurting Greencard applicants, its also not a smart thing from security and public safety perspective to sit on someone's name check process while that someone is living and working on work-permit(EAD)? Does he know that the whole greencard process, being employer centric prevents people from switching jobs, getting promotions etc for 6-7 years? Does he know that Australia gives Greencard to all advanced degree holders in few months time who have 2 years masters from Australian university(accredited CRICOS universities) and allows students to work off-campus when they are on student visas?
Right?

USCIS has to work in FIFO process not RIRO(Random In Random Out)... So they can't send Receipt Notice to Aug 17th filer and then look for July 2nd filer. I sent my concern to congressmen? Now choice is your? I can't force you or USCIS for any action but i can do what ever possible by me.. :)
PS: PD: July 2001 and waiting approx 8 years for GC where my friends are applying for citizenship, if they choose to do so. :)
Question is that there are so many July 2 filers (including me) who have not got any response yet. Therefore, it is not an isolated case. I don't know if emailing to the Director does any good, as long as USCIS keeps admitting that they have not yet sent all receipts (inspite of weekly bulletins). Until 90 days are over, I guess, USCIS will be unresponsive to individual inquiries.

I had my visa interview in Mumbai on Dec 28th. A PIMS Verfication was required for them to be able to issue me a visa. This is for an H1-B extension of stay - My six years expired in Nov. 2007 and my green card is in process.
I was told the time they are taking for procesing is 48 hours but I still have not received any notification to take my papers to the VFS center.
Has anyone in this situation already received their visa and stamped passport and if so how long did it take?

He is right, but the problem is, USCIS and DOS has always done spill over only at the end of fiscal year and not quarterly.
Now who will go and tell them to read their own statute again and reinterprete?? (like the spill over that was done vertical for several years until they realize, "it needs to be horizontal by our statute!!")
Valid point. So its important for us to find out how was DOS reminded of the correct vertical spill over rule and we (IV) should follow the same.

Yes ndialani,i waited for 6 month which i did because i don't know I140 premium started from June 2009(For most the cases).They started in Feb 2009 but its applicable to some limited cases).
May be i would have moved it to premium if i knew in June.Some of the options which i would have tried during that 6 months period was InfoPass,Senator,Ombudsman etc but wasn't very serious about 140 as i thought it may take some years for gc(since the dates very moving very slowly at that time).
