The employer will come up with many excuses to not interview a candidate or hire. If the law doesn't allow you to discriminate when hiring based on national origin or EAD or whatever, rejecting candidates even for an interview doesn't make sense.
Interview is part of the hiring and recruiting processes. Would you say employers putting a job ad saying we will only interview someone from a particular nationality is allowed?
However, the more important point is we are fighting to get multi-year EAD in IV among other things. The law doesn't allow discrimination based on EAD for hiring. Let the govt lawyers and employers figure it out if not even interviewing candidates because of EAD comes under the purview of hiring or not and if it is legal or not.

You have to be kidding! Here people are crying to get there EAD's extended and you think the Govt will give us citizenship???
Please i suggest everyone to wake up and smell the coffee/chai.
If you think giving us citizenship will be easy becoz it will prop up their vote bank think again coz it will never happen. Imagine the headlines which says recession time 10M americans out of job, foreign workers to get citizenship LMAO!
Forget this ever happening in a recession time and not much of a chance in the boom time either, see how the Anti-Immi's will eat everyone up for this ridiculous suggestion, please remember we're nothing in the larger scheme of things for the decision making people, we need to understand our limitation and strengths and play by them, IV does a decent job of that.

The idea is to highlight that legal residents (many of them) have been here for ever!! 10 years is almost 15% of an average life span!! If only this thing is highlighted in some strong news papers. Isn't this protectionism at its worst. US is complaining about labor laws in China???? What the heck is this here??? You pay taxes and SS and medicare etc for 10 years and then you are asked to leave??????????? Isn't this slavery??? Either take of the requirement that workers on visas have to pay the required SS / medicare etc or assume responsibility for having taken their hard earned money and let them in as soon as possible into the society.

First and foremost thing we have to understand is that these Memos (Yates and Aytes Memos on AC21) are not legally binding on either USCIS, or the IO issuing denials. They are mere "internal" USCIS guidelines that have no legal standing. There is no option available to us right now, other than requesting (pleading) with USCIS that they follow these guidelines as it's hurting the applicants and their families. And that's what we are doing now, by sending these letters to USCIS top honchos.

Hi,
My labor (EB3) and 140 were approved a while ago.My company has sent H1B extension for three years in Feb 07.There was a query requesting for additional evidence from USICS in Apr 07.They are requesting lot of my company info and nothing about myself.My Company is taking its own sweet time to respond.Now I am eligible to file 485 as per the latest June visa dates for EB3.My question is could I file 485 when H1b extension is pending.My previous I94 expired on May 07.Please help as it is urgent.If the visa dates move back again then it will be horrible.My Company didn't file during concurrent filing and has eaten 2 years of my life and now they may use this to further hold me..any help will be appreciated.

I dont think there is any issue with the way CIS allocates Visa. They clearly have specific definition and reservation when it comes to VISA categories. If you look in that aspect, EB1 comes first then EB2 and EB3. But this is very specific to VISA Category and does not mean the individuals. So If some one, who qualifies for EB2, but for some reason, he applies for Visa under EB3, it is not the fault of the system, it is the fault of the Individual. This includes me, since Iam May 2003, EB3-I. I do qualify for EB2. So I cant crib. If i want, I can change company and file EB2, for which I think, I am qualified or not apply under EB3 knowing the consequences until I find some one who can file my GC in EB2. When I file my GC under EB3, then in true terms, Iam degrading my self and i should face the consequences. Does it not make sense. So, I suggest work towards the immigration bill and try to make calls to get HR.5882 passed, Otherwise, I dont see any future for EB3. May be EB2 is better than EB3 in true definition, but that does not mean EB2 folks are better in anyway than EB3 folks. Hope u all agree.

Your attorney HAS to reply to your inquiries. It is stated in every State's BAR website. Otherwise, you have right to make a complaint that stays with the BAR records forever. BAR has to publish it to anyone who asks for information about that attorney. Attorneys do not want that.
We were in a similar situation. We sent an e-mail and left a voicemail saying something like: "In our point of view, a reasonable time for you to reply to our inquiries is 3 business days. If you do not call us and let us know another reasonable period of time for a reply period immediately, we will assume that you will reply to our inquiries and/or let us know the information about our case coming from USCIS in three days".
I guess we are learning this country's ways.

I have both I-94 attached to passport and also I-94 along with current I-797. I still confused which one to use?
Technicaly you should possess only one I-94. So when USCIS asks for a copy you should submit only the latest. If you submit extra copies you will create more confusion why you possess more than one I-94. My advice just send them the one that is valid and latest. USCIS can determine you live in this country legally from your records including ur passport, I-797, I-20 past EADS etc.

Specter has presented a so-called "chairman's mark" which is comprised of original proposals and some aspects of other bills including the Senate's McCain/Kennedy bill, and the Sensenbrenner/King bill, which has already been passed by the House of Representatives.
The Judiciary Committee hearing is a prelude to full Senate consideration but St. Patrick's Day is likely to delay that for some days after March 17.
This year, for the first time, Congress is taking a week off after the Irish patron saint's day and officially labeling the break as the St. Patrick's Day recess.
That would mean that the earliest likely date for a Senate debate on whatever the judiciary Committee presents it would begin on Monday, March 27.
Given the sharp contrast in the main bills, that debate could some time, weeks if not months to complete.
Meanwhile, Bush noticeably advanced his position on reform in his State of the Union speech to the joint houses of Congress.
"We hear claims that immigrants are somehow bad for the economy, even though this economy could not function without them," he said.
"All these are forms of economic retreat, and they lead in the same direction toward a stagnant and second-rate economy," the president added.
"Keeping America competitive requires an immigration system that upholds our laws, reflects our values and serves the interests of our economy.
"Our nation needs orderly and secure borders. To meet this goal, we must have stronger immigration enforcement and border protection. And we must have a rational, humane guest worker program that rejects amnesty, allows temporary jobs for people who seek them legally, and reduces smuggling and crime at the border," he added.
However, as with previous statements, Bush did not go into detail as to how he exactly defines amnesty.
How he, and Congress, ultimately defines it will have a profound effect on the lives of tens of thousands of undocumented Irish.

My MTR is still pending with USCIS since 6 weeks. I sent form 7001 to Ombudsman office and got a one line reply that 'your case problem request is currently being processed'
Sent letters and supporting documents to 2 US senators, but i got standard reply from them saying they need 30days to find the status. Office of one senator (NJ) was very helpful but not sure how this helps in resolving my case..

IV members have saved you a lot of money on attorney phone calls, getting answers to medical test questions and other general questions. Please contribute to IV so that we can keep this effort going. While everybody is busy collecting documents and paperwork for 485, core IV again is doing there personal paperwork and + lobbying.
Please contribute, especially if you are new and never contributed. Please do not be a freeloader and get your questions answered and run away.
I hope people who posted on this thread and those whose question got answered consider contributing to IV. This was an important question confronting lot of people and lawyers were giving different and vague answers. All the information was researched and given to our members. Everyone was spending hundreds of dollars each asking lawyers this question. Contributing is a way to express your support for the community.

This is something really cheap of you people to think.....
I read a lot of posts where they mentioned that chuck should proceed with the bill.... so that small desi companies dont perish and that will stop abusing the H1B program...
I really dont understand that no one condemed that remark.. Guys who work in big companies are safe by this rule... So what happens to the one sustaining the so called abuses and remaining intact to get their GC's
No wonder we are not able to make progress as much as those illegal immi's do...
Way to go guys... This kind of spirit will take us to great highs
