I have attended the Interview for H1 B renewal at the US consulate in Toronto (Although i see a lot of posts concerning US consulates in India....thought this might be helpful for someone who would attend an interviewat US consulate in Toronto)
I attended the Interview on Jan 16th at toronto for H1 B renewal and i got my passport back on Jan 23rd (4 business days as the officer told me as jan 21st is a holiday...martin Luther king day)
I have been speaking to some people at the consulate and for them it is taking 5-8 business days and for some they got it in 4 business days.....the worst i have seen is for a lady who was coming to the consulate from past 3 weeks everyday and there is no ETA on her status..(i hope she gets her passport soon:) )...
Unfortunately most of the people who attended there did not know of these delays and are struck cancelling and re-booking their flight tickets and extending their hotel stay

In response to this event, Academy Award Nominee Vidhu Vinod Chopra, who produced the run-away successes "Munna Bhai MBBS", and "Lage Raho Munna Bhai" stated, "Mahatma Gandhi has influenced several personalities, including American Civil Rights Leader Martin Luther King, Jr. These young, law-abiding professionals have set out to strive for reform the right way- the Gandhigiri way."
The theme of �Lage Raho Munna Bhai� centers on the usage of non-violent principles to win over difficult and non-co-operating entities. In the movies, character Munna Bhai wins over the tough Dr. Asthana by means of chain deliveries of flower bouquets. The sequel has revived Gandhian principles and popularized the concept of Gandhigiri- literally meaning a symbolic act of peaceful protest across South Asia and the UK.
Rajkumar Hirani, who has directed the Munna Bhai series, had this to say - "When you feel you have been wronged, you feel angry. The best way to overcome what you think is unjust, is to protest peacefully. Be nice to your opponent and let him see your point of view. My well-wishes go out to these educated, highly-skilled professionals who have abided by the law and have been eagerly waiting in line for their Green Cards for nearly ten years."

�Expectations ran high among applicants. Highly-skilled professionals and US employers have incurred financial expenses averaging USD 3,000 or more, per family in just filing and preparation fees, not including the rush to get medical examinations completed on time, or the resulting hurry to get supporting documentation from home countries. Several applicants have had to call off vacations or business trips to be in the US to file �adjustment of status� applications as part of the final stage of the Green Card process. Some applicants or their representatives even traveled personally to Immigration Service Centers to be the first ones to submit. Not to mention the downtime that has resulted in lost productivity to several US businesses", says Aman Kapoor, of Immigration Voice. Aged parents and families in home countries were inconvenienced to source supporting documentation such as birth and baptismal certificates, all resulting in naught.
Although the ability to file for �adjustment of status� during July would not have granted the coveted Green Card, this move alone would have provided several interim benefits to qualifying applicants while waiting for their Green Cards- benefits such as the right to travel and right to work. It is not clear what you mean when you say that. How can you get EAD without filing for 485 [which you can file only when your PD is current].
We applied before the retrogression started
2004 July - labor cleared for my husband
2004 December applied for I140 and I485 --- I 410 approved EAD and AP issued
I was in the country on F1 and applied for I485 along with my husband in 2004
Graduated in 2005 and changed to H4 immediately although not required since the status is Adjuste status
So when my PD becomes current they will let me know if we get GC or not
My question was since i applied for I485 when i was on F1 will it be a problem. I asked my lawyer and he said no. But i dont know how far he is correct.

When you buy a home you sign a contract saying you will pay the loan amount at the end of the loan term with interest. There was a commitment made. And you are saying people who walk away without fulfilling their obligation are smart? Fool!
And who do you think is footing the bill for bailing out those banks? its you and me! You are not only dishonest and unethical, you must be really dumb if you think you are not going to be paying for the mistakes of people like punjabi when they "walk away" from their homes. Idiot!
This reminds me of the following exchange from Seinfeld :

If you want to switch to a different insurer, your premium will increase if you have bad credit history. As someone else said, you need to really think this through because it will be a life-changing decision for you. People who are telling you to go ahead and do it just because it is legal are not giving you good advice. And people who are advising you to go ahead and do it and get a couple more credit cards and a new car while you are at it, well, these people really have no business giving anyone any advice about anything.

Any body know why there are 3341 cases in March 2005 in EB2 I category, is this about the time PERM came?With out quarterly spill over bulletin is going to get stuck in March 2005 till the end of the USCIS financial year.
Yes, PERM was introduced on 28th Mar'05. I guess the high number of EB-2s was due to employers rushing to file under the old system.

It looks like atleast 75% of EB2 I with priority dates 2004 seems to be approved, this should bring down the count of 2004 less than 1000 may be little more than 1000.

You have chance of winning lawsuit if they reject you just based on immigration status. But in USA the employment is at will basis. Both employer and employee can take that option. Last year when I got offer letter that was specified in first page that this employment is at will basis. Lawsuits are more expensive. Generally lawyers will share the benefits of compensation if they take the case freely
now ford, gm, capitalone and I'll post mine when i hear about the explanation from legal.
i dont know if u can sue without much written proof, or if they refused to interview you. but if you do have an interview etc., and some written proof, we may have something

VBkris has been involved with IV statistical analysis of data and has been in meetings with officials. He has come up with an explanation to this news and how it may play out for the last quarter. These denials are patently illegal. They violate both CIS policy and statutory law. Both statutory law and explicit CIS policy are clear on this subject: An employer may not revoke an approved I-140 petition after an adjustment of status application has
been pending for at least 180 days. While we have not seen denials of any of our cases, we have seen a number of such denials by applicants who have contacted our office to assist them with filing motions to reconsider. It is shocking that the CIS
continues to issue denials even after the first MTRs were submitted. They are issuing these denials with full knowledge that there is no legal basis for what they are doing and that their actions violate existing law.
Anyone who receives such a denial must file a motion to reconsider immediately. The CIS has said that they are processing MTRs within 60 days. If the MTR does not result in a reversal of the denial within 60 days, the applicant should proceed in US District Court immediately to see a reversal. Immediate action is necessary to prevent the accumulation of unlawful presence following the denial.

Do things in this order -
1. Find a job first.
2. Secure a good apartment at new job's location.
3. If you need a better car buy one right now.
4. Get some credit cards.
5. Let your home go to foreclosure.
It is a financial decision. Every once in a while, most of us go to different stores and ask them to match the price for the item that we had purchased earlier. If they do not match the price then we return that item. Don't we? Do not get sentimental. Just walk off! Your credit history would get screwed but if you plan it the way I said above, you will be fine. Good luck.
And it won't affect your GC.

My point is if more and more people like you file lawsuits against USCIS for the different kinds of injustice they think USCIS, DOL and DOS had brought on them, we ( all EB categories)will be in better shape to fight together for the bigger cause which is more predictable process and processing and closing as many loopholes as possible in the employment GC journey.

The below number is depressing, however dont you think DOS/USCIS always believe in keeping buffer and they may push the dates somewhere into 2009 just to accept 485 filings?

I received the card production ordered email today morning, after 1 hr again I received a Decision email. Online status shows as "Decision" , does this mean my 485 is approved?

Why don't you just ask those 10 guys you know are comitting fraud ( by not joining the desi consulting companies and trying to workaround etc ) which company\companies they are working with and then file a complaint with DOL about them. I am sure DOL would surely look into their workings and will very very surely find out that they are doing something illegal in other things ( even if this is not one of them ). Those companies will get blacklisted and will set an example for other companies.
But I don't think you should stop anyone who is doing it legitimately. If one qualifies for EB2 and has been in the queue for a long time he has the right to do it.

I am a multiple filer too, my I-485 application filed in early June was approved last week. I hope this gives some reason for optimism for us multiple filers. Good luck to everyone. BTW: I am still a contributing member and will continue to hang out at IV.
congratulations! So you had the second I-485 still pending when teh first one got approved? Did you get any RFE about it from USCIS or were you asked to withdraw one of the petitions?

Due to un-avoidable confusion and uncertainity with the current lawyer, I think I have got no choice to file another 485 with the other pending I-140. Not doing so might result in the 1% chance that my current lawyer did not file 485 correctly. But I will withdraw one 485 application once I get both the receipt numbers. Hope all goes well.......any inputs?
