    Thanks ..So do you have any idea about how long USCIS takes in this situation to complete the name change?

    It's tough to tell. According to processing times on usics.gov, I-90 takes 3.5 months in Nebraska service center. But the form is supposed to be mailed to Phoenix and I could not find any times for the Phoenix office. Since it's a simple correction, I'm hoping a 2-3 week turnaround time but be prepared for a 3+ month wait. If you need to travel, it's better to get an I-551 stamp in your passport so you can travel regardless.

    ALLVOI is like 1300 minutes for 19.99/month.

    Hmm... good option. Though I would still go with Vonage in this case.

    However ALLVOI does offer calling using your mobile phone. They charge $2 extra per month to register your mobile phone (up to 4 phones) and some token charge. Not bad.

    But I would probably go for Vonage and keep Tata Trueroots for those urgent cell phone calls.

    Can somebody comment on the following two things? This has been asked twice before on this thread (once by me and again by somebody else) but has gone unanswered.

    1. How many unused visa numbers can be re-captured? Out of those re-captured, how many can be applied to EB categories? I know this is difficult to estimate this but if we believe that recapturing unused visas would help the retrogression issue, we ought to have some idea (in hundreds? thousands? more?) as to how many visa numbers can be re-captured and used towards EB categories.

    2. Does the President have the authority to implement an administrative relief in this matter, particularly to recapture the unused immigrant visas? Elsewhere I have read that only congress has the authority to do this.

    Please provide links/references or analysis to back up the claims.

    You will be considered a PR the day your I-485 was approved. In my case, I am not sure where they got the 2008 date. Most likely it is a data entry error.

    Based on my conversation with USCIS customer service, when I return to US, at POE the officer will definitely notice the discrepancy that my I-485 was approved on 09/20 but the card says something else. This might lead to further questions... Better to avoid all this and get it corrected.

    It could also lead to issues during citizenship as I am aware of the error. Best is to get a replacement card with correct details. It is surely a hassle considering the 3-4 months wait time, but the right thing to do.

    Yes, it was based on the State you lived. One other thing, you may want to check with Customer Service, since when are you have been actually considered a PR. If they have considered you as a PR since 2008, it is good for you, you will be able to apply for Citizenship sooner

    Hi Guys,
    I have a concurrent filed application (140 still pending) dated back to Oct 2004 and another I-485 application from July, 2007 from different labor but a recently approved 140. My current EAD & AP is based on the first 485 (Oct 2004) which are due for renewal in next 4 months. Now I want my EAD/AP to be based on July 2007 I-485 (second one) since underlying 140 is approved. Here is my dilema:
    1. When I renew EAD/AP should I check that its renewal or initial application option.
    2. How can I make sure (atleast try) the new EAD/AP will not be tied to old 485 but the new one (will send the new 485 receipt & 140 approval notice).

    There are two waves of movement going to happen for EB2 this year. One starting in May and the other starting in July.

    The 12000 unused visa numbers from EB1 is not the total for the year 2011. It is almost certain that, this is the spillover from the first 2 quarters of 2011. Along with this, there are some numbers from EB2 ROW as well. The spillover will only get applied to all those countries which are retrogressed.

    12000 visa numbers would move mathematically the dates to somewhere in Sept 2006 for India and China Eb2. The porting from EB3 to EB2 is still a factor, but that won't exceed more then 1500 (which are ready to be assigned visa).

    In order to utilize these 12000 visa numbers, USCIS may possibly consider 15000 applicants so that they will get 12000 approvable, background check free and non-delayed cases.

    So, i think for EB2 the dates could move to either Oct/Nov/Dec of 2006.

    In July, the next wave of spill over could move the dates further into 2007.

    Man you made my day... atleast i can be happy for coming three weeks, then i will go back to normal after Visa Bulletin Copy/paste.

    Second: They will laugh at you (that's what is taking place. Instead of accepting the mistake and offering an apology, USCIS has only issued a statement about forwarding flowers to Army Medical Center)
    Third: They fight with you (I guess that's what they are gonna do in the court)
    Fouth: Finally you win.

    ITAA President Quits, May Run For Senate

    Harris Miller all but declares run for Virginia seat held by Republican George Allen.

    The chief voice for American IT vendors in Washington is seeking to switch sides and become a target of Capitol Hill lobbyists.

    Harris Miller, 54, this week quit his job for the past 10� years as president of the Information Technology Association of America�the lobbying arm of the IT industry�to run for the U.S. Senate from Virginia. A Democrat, Miller is eying the seat held by Republican George Allen. Miller says he'll make an official announcement on whether he'll run next week. But in a telephone interview, Miller sounded like a candidate. He already reserved a domain name for his campaign: miller2006.org.

    Miller says top Virginia political leaders, including the retiring and popular Virginia Gov. Mark Warner, a former high-tech executive who's mulling a run for president, urged him to run for the Senate.

    As head of the ITAA, Miller has lobbied Congress to liberalize laws such as the H-1B visa program to allow a greater number of foreign IT workers to be employed in the United States, as well as opposed efforts to penalize American businesses from outsourcing work overseas. Miller's positions on these matters have been attacked by some members of the liberal wing of the Democrat Party who seek to limit the importing of IT workers and the exporting of IT jobs as a way to protect American jobs.

    But Miller suggests his views have been misinterpreted by critics, saying he isn't pro- or anti-outsourcing, but recognizes that American businesses operate worldwide and have the right to hire workers in countries where they conduct business. Placing limits on outsourcing could hurt efforts to open foreign markets to American IT wares, he contends.

    Instead, government should back programs that encourage the creation of new IT jobs in the United States. For instance, he says he's a long-time advocate of programs to bring broadband and other high technologies to American rural areas as a way to attract IT jobs to those areas. He cites a Warner administration program to create hundreds of high-tech jobs by providing broadband Internet connections to businesses in southwest Virginia. "Five years ago, it was not an option, the area didn't have access to the Internet and technology, and those jobs might have gone to Mexico, India, or China," Miller says.

    Miller says the United States isn't investing enough in education and worker retraining, as well as IT research and development and broadband, adding that America has fallen behind some other countries. If elected, he says he'd push for increased investments in these areas. "We have to figure out how to run faster, jump higher than our competitors," he says.

    Before joining the ITAA, Miller ran a consulting and lobbying firm in Washington, and served as deputy director of personnel management for Congressional relations in the Carter administration.

    Replacing Miller as interim ITAA president is Robert Laurence, who had been Sybase VP of public sector.

    There is no contract to change the plans. I just spoke to Vonage customer service. She clearly explained me about the contract requirements. In fact there is no commitment for the new users also. The 1-year contract which shows on the website is for the Phone Adapter. They only charge for the phone adapter if you discontinue your service before 1 year. No strings for the existing customers.

    When he was noting down all my info, I mentioned about LUD on my I-140 (approved) for 8-5-07 and he said.. it does mean anything since they still need to mail applicants receipts no matter what stage is your application is processed under.

    Sent my application on Jul 2nd by 9:01 to NSC. Checks not cashed yet. No updates of any kind !!!! Want to find out if anyone else in the same situation. Thanks..

    You can't move to EB2 if both employer and position remain the same. I was promoted after working with them for 3 years!:rolleyes: Plus I have a Masters in Computer Science. My new position required more experience and a Master's Degree, hence qualified for an EB2.

    Similarly, you can change employers and look for a better job. Then you can use the experience gained at the previous employer. But, ALWAYS, the job requirement has to state the need for years of experience or Advanced degree.

    This helps answer my question. I am a little unclear about promotions and whether that will qualify one for a new labor, etc. I personally am not planning to change anything at the moment. My promotion, etc is not being stalled because of my status. So I am OK. Thanks again for your answer.

    Theoretically, you are right. If DOS sees no demand per CIS, they should make it CURRENT for EB2 I/C (assuming they did clear all pre072007 inventory)

    This is why I was saying, they just need to add a couple month to keep the pipe full.
    Also, per law, they don't have whole 2800 to approve in a month, or a day, they have to do it by quarters. So they don't even need 2800, if they have only 800 EB2I in inventory (demand), they don't have to make it CURRENT.

    I would hope CIS inventory can how which are pre-adjudicated, which are new, which are RFEs though. Their numbers are always bigger than DOS demand, so I would think DOS has a better picture which CIS is providing (or at least estimating on a formula)

    If it is the law that they need to make it current, then if they don't, they are opening themselves to a strong possibility of a class-action lawsuit.
