He interfiled from EB3 to EB2.
His EB3 PD - 12/2003
He got the EB2 approved sometime in Jan 2009.
His RD - 05/2009 (Yes it is right, he applied his 485 in May 2009).

Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

Doesn't DOL have a directive telling employers, they have to try to recruit US Citizens first, and only if they do not find properly qualified US Citizens they can go on to search for people having 'other work authorizations' . Isn't that the whole basis for the approval of our Labor certifications in the first place???
So can the employers not use that directive as a legal loophole and try to prescreen the candidates and ask them whether they are US Citizens or GC or EAD or H1 and so on... as a hidden ploy to figure out whether you are GC or EAD while externally they can still put on a facade that they are just strictly following the legal directives that DOL has laid out?

My H1-B was extended in October 2007 for three more years. My wife went to India and is going through this PIMS BS now. Chennai Consulte applied on Feb 6th. Some cases listed on this forum are scary as hell. Called the VFS office, all they say is they have not received the pp. After four days got the number for the consulate from VFS. Calling them daily. Same story, with each passing day, I could sense the increasing irritation in the voice of the consulate personnel to my questions. I wish I could talk to them in person and vent out my anger. This afternoon I called the DOS. The number is 202-663-1225 incase anyone needs it. I explained my case and asked her if they are missing any information. The reply: No your VISA looks fine. Then the robotic answer, PIMS verification is under process.
I think VFS should specify it on their website and warn people about these delays. Warn people about the PIMS BS and suggest that they should not make any travel plans till they are sure this PIMS BS is resolved.

This is not the correct understanding. I know this myth is propogated millions of times in millions of board and so now this myth has become "truth" for millions. But that is not the correct way USCIS does things.
Country specific limit - 9% does NOT have any realtion to "assigning numbers". it is just meant to "approve 485 - mail you a real physical green card".
In ROW cataegory other countries are also bound with this 9 (7 + 2) % limit for Visa granting. For an example - For Pakistan USCIS will never grant more than 9% visa per year no matter how many applications from Pakistan have been assigned a valid visa number. Same will go true for Britain or any "other" country.
In reality How USCIS divide 28.6% among countires - That is unknown mystery and nobody surely know that. And that is why I had to assume "equal shares - 5 part" in my analysis assuming USCIS works fairly but we all know that is a bullshit too :)

Let's take an example. Suppose for some odd coincidence....the first 8000 odd EB3 apps that USCIS processes starting Oct 1.....none are from I,P,C,M. Suppose First 2500 are from Uk, next 2500 from France, next 2500 Germany and the next 508 from Pakistan. Now the number for ROW at this point would be 8008. Now they get another app from UK next. Will they refuse to process that app as the ROW figure had reached? Then they will still process more than 2500 for I,P,C,M. Won't that be unfair to UK applicants.
As I have said a couple of times now, and so have a few others - ROW cannot be capped at X/5. Due to the high demand from I,P,C,M....it likely gets a MINIMUM of (100 - (7 X 4)) X EB3 cap.

My priority date is current this month (Sep. 2010). An InfoPass appointment inquiry on Sep. 3 and a congressional inquiry on Sep. 9 answered that my case is being actively worked on by an immigration officer since Sep. 1. SR on Sep. 10 responded that visa numbers are not available for my case. SR response was dated Sep. 10 � same date when it was initiated. On Sep. 15 my I-485 got approved. And here is the funniest part. I received the I-485 approval notice and the SR response that said �no visa numbers available� on Sep. 20 � both on the same day � by snail mail. What a contradiction? Such are the ways of USCIS. Why do we not want to question them? Would raising this issue with the Ombudsman be of any use? Can this be presented as a proof of a hideously mismanaged government entity?
Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. They would rather waste their time either on useless task of tracking or calling customer service every single day.

How would it be to forward the media coverage links to all the attorneys so that they are aware of what is happening and also provide some kind of support or atleast get associated with IV. I filed a G28 to allow me to represent my wife. I did not use an attorney. If you are filing for more than one person then I think that a G28 is worth it. It is a trivial form.
