The link is related to the fingerprinting background check. Almost 100% of the time the automated system returns an FBI record (an existance or not of a "rap sheet"). Only in rare cases when the finger prints are not clear USCIS sends a new FP notice.
The issue here is the FBI name check which returns less than 68% in the automated response. Around 32% of cases (485/n400) are delayed of which less than 1% really may have a negative record most of which are reported by IBIS and finger print check.
FOIPA only provides main file check report (not reference file report) which in any case is worthless for most applicants who have never committed a crime but are stuck in the name check due to a flawed soundex alogirthm that is applied for both roman based and non roman based names. Correct. We need to boycott them when they become unreasonable. A great man once moved an entire nation to do just that for a much greater purpose and it delivered results just over 60 years ago.

By the way fellow IVans, don't forget to keep one copy of every thing (of course NOT the sealed cover)of AOS, EAD, AP filing for your records and future reference. Friday evn. after 3.00 PM is a good time at your office copier. Don't use - Automatic Document feeder (whatever thay call it - you pile your papers on top and press button); do it the hard way. One paper after another.
Don't comeback and CRY that you Original Approval Notice or I-94 or BC or something like that was stuck in the copier and now damaged.
In the section 11 of the document what should be the text incase you are supporting your spouse and child @100%

House Majority leader Tom Delay has resigned and will not seek the Majority post until next year. See here:

Tom Delay was considered to be anti-immigration that tightened immigration laws according to anti-immigration organizations like www.numbersusa.com. He voted in favor of HR 4437 that is a nightmare for illegal immigration but does not address the ones already here illegally. And no, there is no mention of legal immigration facing backlogs in this bill either. Just enforcement to crackdown on illegal immigration. There are 3 house members likely to seek the position and replace Tom Delay:

Previously a lot of visas flowed into EB3 because USCIS misinterpreted ( rather did not take into account) the AC21 change, which suggests that the per-category spill over numbers must be used within the category before flowing out of the category.
Unfortunately, when they realized it, they seem to now ignore (or have always ignored) the wording of EB1&EB2 numbers flowing in EB3. A lot of people here don't agree with this interpretation, but I am very sure that USCIS is misreading the law and is shafting EB3 big time.

If you have any idea's, lets work on a letter campaign to make USCIS aware of this. I finally got the letters and the root cause of my I485 denial. My previous employer informed that they used my approved I140 for another employee. As many of you might know this I140 substitution practice was a loophole until June 2007. These days companies can not do this any more.
So probably when my I485 came up for adjudication, there was no I140 since it had been used and hence they denied it. Now, I changed jobs per AC21 rules--yeah the famous rule that USCIS ignores. I am waiting on my current attorneys to file an MTR as soon as possible.
Question to forum members:
1. Are there folks in EXACTLY similar situation?
2. If yes, after filing MTR and it getting accepted, what are next steps since one definitely needs a approved I140?
3. Further to #2 above, does one need to file another I140 and port the previous date? I am sure this would take longer time than the current H1b that I hold until June 2009.
4. Can any one share lawyer name and contact info who might have favorably helped a forum member so that I can contact the person and get a second opinion to discuss legal strategies that might be available.

As far as I am concerned, H1B visa holders have to no benefits... we pay SS taxes, federal taxes, Medicaid, state etc. As soon as we loose our jobs we are told we have a couple of days to leave the country - even when we have been here for years. What an inhumane way to treat a tax payer.

Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.

H1/L1 restrictions are not going to encourage american kids. It does not impact their thinking. Maths, science are tougher subjects for kids. Kids in India were pushed by their parents to study science in search for a good career. Kids here have a lot other avenues which are more attractive to a kid. Kids do not understand L1/H1. 90% of adult population here does not understand H1/L1. REstricting H1/L1 will not influence a kid to take up science and engineering.

Personally I feel the hearing and the vote in committee may happen suddenly. So don't think you will be able to watch it live.
