Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. My status was changed from Initial Review to PDA.The status changed on Aug 7th. There is no CPO or Decision status in between.

Have there been reasons other than Pims for delays? I see a lot of 221g cases in the forums. Are these due to PIMS?

My lawyer contacted DOS and they said it was awaiting a "security clearance" and were not able to say anything about how much time it would take. Hope it helps.

May be it was updated on the website on 25th Aug 09, System date should be present on the report, Report with out date on it is meaning less, I hope the USCIS IT team will understand that, I dont understand what kind of reporting specialists USCIS hires, that is a fundamental thing USCIS should know, Report should have a system time stamp on it saying when it was generated.

Very good. If it passes in 2-3 weeks, which we all hope is the case, that will be just excellent. Since there are some provisions like guest worker program for 11 million illegals also part of this bill, it is possible that the debate for this bill may also take sometime and may go through some roller coaster rides. Let's hope not.
Once the law is passed, the date of implementation is usually part of the law. I am not able to confirm if these are any dates mentioned in this bill. But my guess is it should take effect immediately. I did search for the complete text of the proposed bill but could not find the link. Could someone please post the link to the complete proposed bill?

I don't think you want to go into foreclosure. It will mar your credit report for sure, and it may be difficult for you to get another homeowners loan in the future.
Why don't you consider renting out your house via a property management firm?

Hey BP, taking your numbers and assuming horizontal spill over instead of vertical would make eb2 all over current. total spill over from eb1 = 53807, total eb2 quota = 40040, pending eb2 = 74932
assume eb1 demand = 5000, eb2 demand = 20000
we can easily see eb2 getting completely approved.
I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. You stand is understandable, but I still will urge you to join me. It is of course not illegal but unfair towards the people already in EB2 line. If there were no limits on visas, it will not have been an issue to begin with. Think about the depth of the issue.

Mostly it is because I don't think MOST of the folks who use PD porting are doing it illegally or even cutting through the line undeservedly. If I am not wrong, these folks will have put in the time (work exp wise and/or added higher education) and should rightfully get the position certified as EB2.
Now granted that there are always a small minority people who genuinely are not deserving. First, can you define in your view what kind of PD porting is unethical?
Additionally, can you back up your claims by providing any kind of stats of such cases per year and how much impact it really causes to the GC wait time of those already waiting in queue for EB2? Are they that significant for you and Rolling Stone to feel so wronged?
In conclusion, unlike the unjust labor substitution process, your case is not convincing because I don't think most people availing PD porting are doing anything wrong legally and ethically. I would love to see stats and examples though.

I have sent the letters today to WH and IV.
I have also sent group emails to my batchmates from my engg college asking them to join IV. I think everyone should do that - this will help IV to Increase its Memberships.
I had one more suggestion too - (this has recd less support in the past).
we need to put in a statement that many legals are not buying a house because of the uncertainity in the GC process. even the congressmen will be more patient with our cause when we mention housing.
I doubt if this is true. There was a poll created a while back that asked this question to everyone, and fully 50% or more had already bought a house even though they had not even reached the 485 stage. I personally would not wait for GC to buy the house. If the status quo remains, it will probably be 5-6 years before they even take up my case for consideration. The housing market would certainly have recovered by then. Barring local minima and maxima, the overall trend in the housing market is always of a somewhat steady and gradual incline.
Just my 2 cents.

If they offer you the job, well and good, but if not, I think you can litigate for various reasons because what they did is not right.

Got CPO email around 10.45 am today for both me and my wife. Big thanks to IV. Big thanks to Pappu, Jay, Aman, Anu ad all my wonderful IV friends. I will also continue supporting Iv and activities time to time.
