Now as per my lawyer's advice probably we will need to change her status back to H4.
Do you know how much time it will take to get that status change? What if your PD is no longer current?

Pappu, special thanks for researching this topic, and posting updates regularly.
Last week I too consulted a high profile (about $200 per 15 minutes... you should be able to guess, I am not sure I am alowed to mention the name) lawyer to discuss this issue. To give you a brief background, my lawyer did not include the Employment Verification letter
1) He told me that he would re-submit the AOS. The comparison to the medical clearance requirement, according to him, was pointless, as they are two different things. If USCIS issues a statement they will not reject solely based on the EVL, then we can assume that is the truth. Their statement on Medical clearance cannot be interpreted to say they won't reject on the basis of another missing requirement, say the EVL.
2) Filing two AOS packets can indeed also cause confusion, but it is a smaller risk according to him, and should be mitigated by a covering letter that says you are re-submitting to provide the XYZ document that was missed from the first packet.
Based on this info, I have asked my lawyer to get a confirmation from the USCIS on the document that he missed in my case-- the EVL. If USCIS okays that, we do not resubmit. If they don't do that within a week, I will try to re-submit... not going to be easy considering my lawyer may not be in agreement... but that is what would be the correct way out of this, according to the second opinion I got last week.

i guess some of the folks who are in the same GC boat do not approve of a few getting into citizenship while the rest are left behind.
This is fully understandable.
All what we are aiming for, finally, is citizenship.
All what a few red dotted folks here are talking about is to set a fair timeline for it.
Say if one gets the GC after 4 yrs of application, s/he will get a citizenship roughly 10 yrs from that start. What is wrong if someone who is waiting in queue for 10 years can finally apply for citizenship?
We need to find a plan to propose that will speed up the GC process as well as deliver citizenship after a foreseeable period of time.
There is no discrimination here.

Yes, it was based on the State you lived. One other thing, you may want to check with Customer Service, since when are you have been actually considered a PR. If they have considered you as a PR since 2008, it is good for you, you will be able to apply for Citizenship sooner

It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Clearly the USCIS and the DOS have absolutely no clue as to how to manage the visa regime.
On top of that these smart asses think they are answerable to none - since this is just a matter of 'to be' immigrants.
Now the class action suit proposed by AILF will surely shock them from their oblivion and bring them down to REAL world.

I really think, second July is the D day here. They can't stop accepting new applications becuase of mere speculation that lot of folks can apply. If indeed thousands of people apply on the second, the numbers will become U on the 3rd. I still think if your applications gets in on the 2nd, you will squeeze in..

I really think, second July is the D day here. They can't stop accepting new applications becuase of mere speculation that lot of folks can apply. If indeed thousands of people apply on the second, the numbers will become U on the 3rd. I still think if your applications gets in on the 2nd, you will squeeze in..

I was just wondering if anybody knows about Science & Technology Related VISA Issuance Delay at Indian consulates and embassy. Is it a new thing introdcuced recently? Now they require you to fill up a 6-pages long questionnaire and wait 2-3 weeks delay. Anybody on h1-B has gone through this?

If you do not bring complete information to your visa interview, for example, a completed questionnaire, your resume and research summary, you may have your application delayed even further, or may be refused a visa and be required to apply again
As soon as the processing of your visa is complete, the Visa Section will contact you and explain how you can pick up the visa. You do not need to contact the Visa Section, make a new appointment or pay the Visa Application Fee again

EB3-I can benefit only if per country cap is removed. Can IV do something to get this done as part of Admin Fix? Otherwise EB3-I will rot in 2001/2002 for next 3 more years.
