    Hello all
I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??

Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????

My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

Isn't it a shame on us to go for Rally to get GC?????:D

Just think that you will get it when time comes, otherwise pack up.

Please don't take much tension as life is very short. I am assuring you all, nothing will happen with law suit and flower campaign.Don't irritate USCIS by doing all this please.

    EB2 India
    PD-2005-May
    I140 approved-Sept 2006
Why don't you enlighten us with the real problem that USCIS is facing?

If you think India is Great, why are you here and why did you apply for a GC? Why don't you set an example and leave first?

Nobody is doing anything forcefully. Sending flowers is a Gandhian method as I understand. Dr.Martin Luther King followed the Mahatma's foot steps and succeeded. Don't preach us about US and India.

If you consider it a shame, don't participate and go back. period. Don't tell us to packup.

    [COLOR="DeepSkyBlue"]Your Case Status: Decision

Case Status changed to Decision..with the above message today.

After 2 failed marriages (i mean with 2 different companies)...some risk-taking ..coz, i left my second employer after crossing 200 days since filing I-485 , Used EAD and took up full-time employment with an awesome organization , and then later 2nd employer revoking I-140 that lead to an RFE ...and USCIS keeping the status Response received since Jan 2009 ...and now this ...after opening an SR on 08/10..Looks like it took an exact week since the SR was created.

Of course, my roller-coaster was a small one compared to the rest of the friends in this forum.. Good luck to all and thanks to one and everyone.

    Cheers..

Congrats, Anil. I know it's a big relief....enjoy your freedom..

When one should feel to donate, they can donate. Doesn't mean that you donated, means everyone should donate.
It is about donation, not Haptaa-vasooli.....

So, before taunting anyone you should understand the meaning of "Donation".

Why are you getting defensive, my friend? The member was just pointing out the difficulty of getting donations for hire an octopus. Relax :)

    People,
whatever people may say, flower campaign is a success.
Its tells us one thing.. if we all unite, they cannot ignore us.
At least, we know they are listening. Keep the pressure going.

Nothing will happen. The dates will be retrogresses on Monday. May be we will see 'U' in Visa Bulletin. The AILA will try to pursue DOS and USICS but they will politely say "sorry for the trouble" This will lead to the law suit. Some people will submit their resignation. In the next year you will see those at some higher post somewhere.

Wow. We are living in the great country built by Immigrants were there is no value of Immigrant. For undocumented immigrants, there are senators to help them. For rich people, they have money so don't have to do anything. For middle class immigrant like you and me IV forum is there to show our frustration.

I am now seriously thinking of going back to my home country were I would be considered moron who came back from US.

Who said US is very differnet from India..:D

Actually, this is a new rule it seems. We also faced it this time. Airlines have to verify the visa. When I was flying through Air India via jfk and also when I was returning from India, both times my visa on my passport was scanned by airlines official. You will see some guy carrying a laptop kind of device and he/she will scan your visa before even you go for boarding pass. In our case, since visa was expired they asked for Advanced Parole.

It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers. After that she had issued the boarding pass.

Friends, you may think I am very meek. This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.

Don't think only Non-Indians treat Indians shabbily. Our enemy is within.

If I happened to see that lady once again in Chennai -------

    PERM EB2 India
    PD:Feb 2006
    I-140 Approved

    BEC EB2 from same company
    PD: Dec 2004
    Just approved today

I am applying I-485 on July 2nd based on approved I-140 PD Feb 2006
as I don't want to take chance with refiling I-140 for PD Dec 2004.

In future can I apply I-140 for labor with PD Dec 2004 & on approval can I switch the
PD for my pending I-485 if dates are current for that PD?

Gurus below is an article on Murthy's site Posted in Jul 2000 which is related to the question I had above.

    http://www.murthy.com/news/UDpen485.html
According to the year 2000 INS memorandum about procedures for substituting a new I-140 (employment-based petition) approval in a pending employment-based adjustment case

"The rules are generally straightforward in the employment-based context. The regulations clearly states that if a person is the beneficiary of multiple I-140 approvals, s/he is entitled to the earliest priority date."

Anybody please advice if this is still true and based on that
for pending I-485 can PD be transfered in the same category(EB2) once my second I-140 with better priority date is approved?

We all know that IV is not Indian. More Indian!=All Indian. Lets not worry about it and most importantly I request IV members from all countries to ignore it as a reporter mistake as they script stories in their fashion to elicit more coverage. It is almost impossible to edit the story that has been distributed by Reuters/AP. Once its gone, its out of their hands.

01/24/2006: Senate May Table Comprehensive Immigration Reform Bills As Early As February 2, Thursday

Unconfirmed sources indicate that the Senate may table this bill earlier than expected. Since there is the nightmarish Sensenbrenner border protection bill that will come up with the comprehensive immigration reform legislation, it appears that the pro-immigration forces may have to energize their forces and start working on the critical immigration legislation.

How about, they are expecting so many application 140 plus 485...that THEY DO NOT WANT TO PROCESS ANY APPLICATION...like always - THEY WILL SIT and EAT BURGERS and dont WANT TO DO ANY WORK...nothing new here folks...

I understand your frustration, but easy there Jonty. To blindly accuse of someone of not doing their work is not good. Again I understand the frustration but we need to go easy on the criticisim.

Jan 1 1970. Before that you can submit affidavits.
I didn't submit non-availabilty to attorney. Last time in Sep 2005, I was about to file I-485, they didn't ask. Not sure, if the Non-Availability thing came up after Oct 2005.

My father tried to get a Non Availability certificate but they told since the birth is registered they can't issue one and that they also won't change the name... (after the incident where that MP tried to sneak people into Canada they are very strict it seems)

    Guys,
Have we contacted national newspapers New York Times,Washington Post ?

In effort to make legislators and people aware of legal immigration issues, we should take help of media. This would be most effective.

Hiring a lobbying firm to pursue our issues with legislators is a good idea but it should be accompanied with media awareness as well. This is money intensive project and it will take time to reach its target of 100k.We need some other channel of awareness open as well and we need to do that soon so that it has some effect on Feb bills.

People are not aware that we are going thru such long waits to get immigrate legally. This issue needs to be highlighted.

Lawmakers would listen to legal immigration issues if they read in leading newspapers NYT and Washington Post. These newspapers are very influential.

This is ridiculous; all I see is unnecessary hurdles being produced I see efforts of discouragement towards coming to this country on H1B. First they suddenly start auditing 60% PERM cases and now suddenly delaying visa unreasonablyincreasing Visa numbers and making Green Card processing faster is aside, we are facing other problems.

Here's a very good recent example

    http://www.computerworld.com/action/article.do?command=viewArticleBasic&taxonomyId=13&articleId=9111963&intsrc=hm_topic

Point to be noted is that this case was not dismissed on merit, but that plaintiff's have not been able to prove significant damages resulting from the rule. A general 'dissatisfaction' with the rule ( for e.g. my wait times will increase if porting continues) doesnot translate into significant damages ( such as I'm losing the job). The merit of the case was never discussed!.

It would be interesting to see how many of the 'Yes' are going to remain 'Yes' when it comes to having their names on a lawsuit filed against USCIS (the whole list will be going to USCIS). It will be interesting to see how many of you stridently remaining anonymous on a (relatively) harmless public forum such as IV are going to come out in public to fight the USCIS. Good luck guys.

And happy nightmares whenver your cases get (not so) Soft LUDs. Is it because you joined the case? you never know.

    Good luck once more

    Good post!

Since GC is for the future job, any damage such as "I am losing current job" is legally immaterial and irrelevant.
